Rep. Shusterman eyes 3D-printed gun regulations

Plans bill in new session to regulate them like regular guns

State Rep. Melissa Shusterman, D-157th Dist., plans to introduce a bill to regulate the use of 3D-printed firearms, which are a form of “ghost guns,” to the Pennsylvania Legislature in the upcoming session season.

According to a press release from Shusterman’s office, 3D-printed firearms are not regulated in Pennsylvania. These guns and their parts lack identifying features, such as serial numbers, which are commonly found on regularly manufactured firearms. This makes 3D-printed guns and parts difficult to trace when found at a crime scene.

Ghost gun use is on the rise both in the commonwealth and around the country. The federal Bureau of Alcohol Tabacco and Firearms reports that from 2018 to 2021 there was a 1,000 percent increase in local law enforcement reporting of ghost guns to the ATF. The Pennsylvania State Police report that the number of ghost guns seized by state and local police within the commonwealth doubled from 2022 to 2023, according to the release.

Shusterman’s legislation would treat 3D-printed firearms as standard firearms under Pennsylvania’s laws and regulations. Additionally, Shusterman’s legislation would prohibit anyone from printing a firearm without a proper gun manufacturing license from the federal government.

“3D-Printed guns shoot like a gun and they can kill like a gun,” Shusterman said. “It’s common sense we should regulate them like guns. 3D-printed guns should not be exempt from the laws and regulations governing their manufacture, sale and use. We’re seeing the criminal use of ghost guns rise at an alarming rate. To aid law enforcement efforts to crack down on untraceable guns, our laws must apply to 3D-printed firearms. My legislation will give law enforcement one of the tools they need to protect themselves, and our communities, from gun violence,” she said in the release.

State Rep. Morgan Cephas, D-192nd Dist., introduced H.B. 777 last year, which would ban the sale of individual parts or “kits” of ghost guns. The bill passed the House with bipartisan support and then sat in the state Senate Judiciary Committee since April 12, 2024, and received no further action, leading to its expiration at the end of the 2023-2024 legislative session, according to Shusterman.

“Staying a step ahead of technology is always a challenge, but we are losing that battle every day that we don’t have regulations on the 3D printing of firearms,” Cephas said. “Not only are they dangerous because they are untraceable ‘ghost guns,’ which the House voted to outlaw last year, but they are also undetectable by standard security measures. Law enforcement officials need these tools to be able to protect our communities across the state from deadly firearms ending up in the wrong hands. I support Rep. Shusterman’s legislation to treat 3D-printed guns as any other firearm under our current laws and renew support for my correlated legislation that would make these guns illegal to create, sell and possess.”

Paoli Hospital Receives Funding to Support Overcrowding

Paoli Hospital has been overwhelmed since the closure of both Jennersville and Brandywine hospitals. It has experienced a 16 percent increase in emergency room volumes and at times hits 100 percent in capacity levels, writes Bill Rettew for The Daily Local News.  

But now, with $2 million in pandemic relief grants, the hospital will be expanding its emergency department. Eight new treatment rooms will be added.  

The grants come from American Rescue funding and were secured by State Representative Melissa Shusterman and State Senator Carolyn Comitta. Shusterman said at a press conference that this funding will keep patients out of hallways and supply closets.

Law to improve communication between Health Department and nursing homes

HARRISBURG, July 18 – State Rep. Melissa Shusterman, D-Chester, is celebrating final passage by the General Assembly of H.B. 1853. Governor Shapiro signed the bill in to law on July 17 and it has become Act 75 of 2024.

The bill was introduced by Rep. Shusterman, and co-sponsored by Rep. Kristen Marcell (R-Bucks), in November 2023. It passed out of the House in April of this year with a strong bipartisan vote of 124-77. Senate final passage occurred on July 11 with a bipartisan vote of 47-2.

HARRISBURG — Two bills that attempt to curb election influence garnered in two different ways — via so-called ‘dark money’ and by artificial intelligence — advanced in bipartisan committee votes on Monday, although it appears neither is a finished product.

Rep. Melissa Shusterman, D-Chester, said she worked in television before getting elected to the House and it was acknowledged that the editing process could be used in the wrong way.

“I kind of look at AI as editing on steroids,” she said. “This is a step in the right direction.”

HARRISBURG, Pa. – Legislation intended to strengthen Megan’s Law and establish a process for family arbitration in order to avoid civil court were among six bills signed into law earlier this month by Gov. Josh Shapiro.

State Rep. Melissa Shusterman, D- Chester, introduced House Bill 917, now Act 12 of 2024, establishing the Pennsylvania Family Law Arbitration Act.

The legislation adds to Pennsylvania’s Judicial Code by creating the process for family law arbitration. It allows families to settle disputes voluntarily and privately, avoiding settling the matter in court.

A third party is paid by those involved to serve as the arbitrator.

The Equal Pay Law, designed to expand protections against wage discrimination, has been passed by the Pennsylvania House of Representatives. 

House Bill 98 was introduced by state Reps. Donna Bullock, D-Philadelphia, Melissa Shusterman, D-Chester, and Jenn O’Mara, D-Delaware, and would prohibit employers from discriminating and paying workers less due to gender, race, or ethnicity. In addition, the legislation would add protections for retaliation and increase monetary penalties from $50-$200 to $2,500-$5,000 in cases where employers discharge or discriminate against an employee for filing a complaint.

Pa. House passes Equal Pay Law to curb wage discrimination

Pennsylvania is the only state where live pigeons are regularly used for target shooting, animal rights advocates say, and legislation that passed a state House committee Monday could put an end to the centuries-old practice. 

“What we see in public polls is overwhelmingly that Pennsylvanians, like those here in this room, support ending live pigeon shoots,” Schusterman, chairperson of the Legislature’s bicameral Animal Protection Caucus, said during Monday’s Judiciary Committee meeting.

Pennsylvania lawmaker ‘in a war with my daughter’ over ingredients wants to ban color food dyes

HARRISBURG, Pa. (WHTM) — How hard is it to keep your kids from eating ingredients you don’t want them to eat?

Very hard, says Rep. Natalie Mihalek (R-Allegheny/Washington), who began paying close attention to food labels a few years ago.

So a bill Mihalek is sponsoring would ban several kinds of red, yellow and blue food dyes in Pennsylvania; a companion bill sponsored by Rep. Melissa Shusterman (D-Chester) would ban three other ingredients, including brominated vegetable oil.

“This is a bipartisan effort to clean up our diets,” Mihalek said, citing evidence the ingredients pose health risks and have “no nutritional value.”

The bill, which was introduced on the 51st anniversary of Roe v. Wade, seeks to overturn Act 122 of 2011 — which is also known as a Targeted Regulation of Abortion Providers law. Under TRAP laws, abortion facilities are required to adhere to the same regulations as ambulatory surgical centers, including mandates on parking lot designs, hallway widths, recovery room structures, and plumbing and ventilation systems.

5 gun control bills advance in Pa. House with GOP, Dems fully divided on each proposal

HARRISBURG — Pennsylvania House Democrats on Wednesday advanced five measures regulating firearms toward a potential floor vote including a proposed ban on the sale of assault weapons.

The vote split on each proposal by members of the House Judiciary Committee was 14-11 with all Democrats in favor and all Republicans opposed. Should the measures be successfully voted out of the House behind Democrats’ one-seat majority in the full chamber, the initiatives would advance to the state Senate which is in the control of Republicans.

Tredyffrin Township Secures $2.2 Million in State Funding for Key Stormwater Projects

BERWYN, PA — In an effort to combat the effects of stormwater runoff and flooding, Tredyffrin Township has been awarded over $2.2 million in grant funding from the Commonwealth of Pennsylvania. PENNSYLVANIA — State Representative Melissa Shusterman, a Democrat from Chester County, has co-sponsored a major legislative victory for working families in Pennsylvania. A bill that would prohibit Pennsylvania courts from cooperating with other states’ prosecutions of people who violate their anti-abortion laws passed the state House 117-86 on Wednesday. 

House Bill 1786, co-sponsored by state Reps. Mary Jo Daley (D-Montgomery), and Melissa Shusterman (D-Chester), would codify an executive order issued by then-Gov. Tom Wolf in 2022 that protects people who come to Pennsylvania seeking reproductive health care from being penalized by their home states. 

“Since the Supreme Court’s decision in Dobbs v Jackson Women’s Health Organization, an alarming number of states have enacted total or near total bans on abortion because of this decision,” Shusterman said. “While we cannot prevent other states from criminalizing abortion, what we can do is protect individuals seeking and providing reproductive healthcare services here in the Commonwealth of Pennsylvania.”

PENNSYLVANIA — The Pennsylvania House of Representatives this week passed a tax code bill that includes a provision to expand the state’s Child and Dependent Care Enhancement Tax Credit. The provision, championed by State Reps. Tina Davis, D-Bucks, and Melissa Shusterman, D-Chester, aims to increase the percentage taxpayers can claim as well as raise the allowable expenses.

The provision comes in response to the end of pandemic-era federal aid to childcare providers on September 30. The proposed legislation will build off of the childcare tax credit that was passed as part of Pennsylvania’s 2022 budget. Davis and Shusterman are proposing a tax credit for families whose daycare costs exceed 10 percent of their taxable income, capped at 20 percent of daycare costs or $5,000, whichever is lower. Specifically, the legislation would increase the credit that can be claimed off PA taxes each year from the current 30 percent of the federal filing credit to 50 percent.”

New funding will improve local watersheds in West Chester area

WEST CHESTER — The Willistown Conservation Trust will receive $127,000 in funding to improve local watersheds, state Sen. Carolyn Comitta and state Rep. Melissa Shusterman recently announced.

The organization will use the funding for the Rushton Woods Preserve Okehocking Run Watershed Enhancement project to construct a bioretention basin and vegetated swale.

Sommer to election critics: ‘This fishing expedition must end’

…Sommer filed his order denying the request “with prejudice,” meaning the litigants are legally prohibited from re-filing their demands in Common Pleas Court.

“If the petitioners believe they have specific evidence of fraud and have a meritorious case, they can set the allegations forth and pursue them,” Sommer wrote in his decision, which was filed Friday after a reportedly raucous court hearing that took place at the county Justice Center on Monday.

“But they cannot enlist this court in their quest to conduct a free-wheeling audit of cherry-picked precincts in Chester County,” he wrote. Common Pleas courts, he said, are places where judges take testimony, make legal and credibility findings, determine facts, and resolve disputes. “(They) are not forums for the childhood game of ‘I know something you don’t know.’

“Nor is such gamesmanship the manner in which the practice of law is to be conducted,” he added. “This court will not condone such conduct nor will the court allow the judicial process to be abused in the manner. This fishing expedition must end here and now.”

Judge should dismiss recount petitions, Chester County officials claim

WEST CHESTER—The effort by more than two dozen Chester County voters to obtain a recount of votes in their home precincts in recent statewide and local elections may be a case of the critics biting off more than they can chew, according to a filing by the county solicitor’s office.

All but one of the petitions — that were filed without the assistance of an attorney in boilerplate fashion, with “fill in the blank” sections for the specifics of the claims — asked for the recounts in the race for governor and lieutenant governor, races that were won in the state and county by Democrats Josh Shapiro and Austin Davis. The other petition, from a trio of Tredyffrin voters, asks for recounts of that race and those for U.S. Senate, U.S. House of Representatives, and the 157th state Legislative District — all also won by Democrats.

Mystery continues in Chester County political sign thefts

TREDYFFRIN — It won’t rank with the mysteries of who killed Jimmy Hoffa or the identity of Jack the Ripper, but the great Chester County sign theft case of 2022 has still gone unsolved.

On Wednesday, Tredyffrin Police Lt. Tyler Moyer said that no arrests had been made or charges filed in the matter of who stole more than 100 political signs from the front yards of residents of the Wayne area and public right-of-way locations of the township in October.

Moyer said that police had examined a surveillance video taken at a local shopping center where the signs, all from Democratic candidates or with progressive themes, were found, but that they were unable to identify anyone or any vehicle involved well enough to bring charges.

Op/Ed: SB 106 is too radical, too extreme

This past summer, Republicans in the Pennsylvania House and Senate rammed through a bill with several proposed constitutional amendments that would limit personal rights instead of protecting them. One of the amendments included in SB 106 would change the state constitution to say there is no constitutional right to an abortion in Pennsylvania. I spoke in opposition of the bill on the House floor the night it passed. If this proposed amendment were to succeed, it would create a pathway in our commonwealth to ban all abortions without any exceptions.

Apple AirTag Used To Find Over 100 Stolen Democratic Campaign Signs, Police Say

Shusterman, who is running for reelection for her seat in the state legislature, said in a Wednesday tweet: “We will not let the radical MAGA right intimidate us. Double the amount of signs taken down will go back up.”

“I think the county party has leaned in heavily to MAGA,” she told Forbes, referring to the wing of the party that supports former President Donald Trump. “And it's not reflective of the majority of Republicans in this area—but they’re quite loud.”

Air Tag leads to dumpster filled with stolen political signs in Chester County

A spokeswoman for state Rep. Melissa Shusterman, the Schuylkill resident who is running for re-election to the 157th Legislative District seat, said police told a committeewoman that one of the sign owners had attached an Apple Air Tag digital tracker to one of the signs that had been taken from their yard. The homeowner was able to determine its location — behind a restaurant and brew pub on Swedesford Road in Berwyn — and told police where it was.

Child Care Tax Credit Proposed

Representatives Tina Davis, D-Bux, and Melissa Shusterman, D-Chester/Montgomery, have introduced House Bill 2737 to provide a tax credit for families whose day care costs exceed 10% of their taxable income. . The tax credit will be capped at 20% of the total day care cost or $5,000, whichever is less. According to the bill text, the total cost to the state would be $10 million.

“As always, my top priorities for this budget season are families, education, and economic development,” Rep. Melissa Shusterman (D-Paoli). “Our state is currently sitting on an $8.5 billion dollar surplus. It’s time to start investing that money in hard-working Pennsylvanians, and Gov. Wolf has proposed a budget that will do just that. It includes a Child and Dependent Care tax credit, to reduce the financial burden of childcare on working families and would enable parents to rejoin the workforce without worrying about how to pay for expensive care.
